These terms and conditions apply to the use of Scenicway and to all purchases in it.
1. Contracting party
Your contracting party is Alen Kvakić, Mollardgasse 49-51, 1060 Wien, Austria, email [email protected] ("we"). Scenicway is aimed at private individuals. You are a "consumer" if you do not use Scenicway for your business.
2. What Scenicway is
- Scenicway is a web app at scenicway.app. It uses artificial intelligence (Google Gemini) to suggest scenic routes, with notes on light, weather, views and stops.
- For driving, Scenicway hands the route to Google Maps. Turn-by-turn guidance there is calculated by Google, and we have no influence on it.
- You can view the demo routes for free without an account.
- Scenicway is not a navigation device and not traffic or safety information. The suggestions are non-binding (see section 11).
3. Account
- You need an account for your own routes and for purchases. You sign in with an email link or with Google.
- One account per person. Use an email address that belongs to you and keep access to it safe.
- You can buy if you are of legal age or your parents agree.
- You can delete your account in the app at any time. Unused routes and periods then lapse, and a running Pro subscription ends.
4. How a purchase is made
Prices and plans in the app are not yet a binding offer. You choose a plan and are taken to Stripe's payment page. There you see the plan and price again and can correct your input or cancel. By clicking the pay button you make a binding offer. The contract is concluded when the payment succeeds and we activate your plan. You receive a confirmation by email. The contract languages are German and English. You can view, save and print these terms on this page at any time.
5. Prices and payment
- Route Pack: €3.99 one-off for 5 routes.
- Roadtrip Pass: €6.99 one-off for 30 days.
- Scenic Pro: €4.99 per month or €39 per year, as a subscription.
All prices are final prices in euros. As a small business under § 6 (1) no. 27 of the Austrian VAT Act (UStG), we do not charge VAT, so none is shown. You pay through Stripe with the payment methods offered there (for example card, Apple Pay, Google Pay, PayPal, SEPA). The Pack and the Pass are paid at purchase. Pro is paid in advance at the start of each period.
6. The plans in detail
- Route Pack: 5 routes that never expire as long as your account exists. Each newly created route uses one route from the pack, and so does a screenshot check.
- Roadtrip Pass: valid for 30 days from purchase and then ends on its own. No subscription, no renewal, no cancellation needed. If you buy another Pass while one is running, it extends the running one by 30 days. While Pro is active a Pass is not needed and cannot be bought. If you take out Pro while a Pass is running, Pro is first charged when the Pass ends (right away if less than two days are left).
- Scenic Pro: renews automatically for one month or one year until you cancel (section 7).
- "Unlimited" for the Pass and Pro means: for normal travel, up to 20 routes a day and 200 (Pass) or 300 (Pro) routes per month, plus 30 (Pass) or 50 (Pro) screenshot checks per month (fair use, section 9). With unusually high use we may switch to a simpler AI model or pause until the next period.
7. Cancelling Pro
- You can cancel Pro at any time on the account page of the app or in Stripe's customer portal. Pro then runs until the end of the paid period and does not renew. There is no partial refund for the rest of the period, except in case of withdrawal (section 13).
- We can cancel Pro with one month's notice to the end of a period. If we shut Scenicway down completely, we refund the unused part of paid periods and unused routes from packs pro rata.
- Both sides keep the right to terminate immediately for good cause.
8. Satisfaction rule and invitations
If you don't like a route, tap "Not great" below it. We then give the route back to you, up to 3 routes per month. This does not apply to results served from our cache. This is a voluntary promise on top of your statutory rights, which it does not limit.
Inviting friends: anyone who signs up through your shared link gets 20 % off their first Roadtrip Pass or first month of Pro (not the yearly plan or the route pack). When they buy for the first time, you get 3 free routes (Pass or Pro) or 1 free route (route pack), for at most 5 friends a month. Your own additional accounts do not count. Free routes do not expire and have no cash value. We may end this offer at any time for the future; routes already earned stay.
9. Fair use and abuse
Not allowed: automated requests (bots, scripts), getting around limits, several accounts to use free offers or credits more than once, and reselling results. If usage looks unusual, we may slow it down temporarily. In case of a serious or repeated breach we may block your account after a prior warning and end the contract for good cause.
10. Availability
We do our best to keep Scenicway available. We cannot promise constant availability, for example during maintenance or outages at Google, Cloudflare, Stripe or map services. We may develop Scenicway further as long as the service you bought essentially remains.
11. Important when driving
- The routes are suggestions made by an AI. They can be wrong, outdated or incomplete: for example wrong places, closed, private, unpaved or prohibited roads or roads unsuitable for your vehicle, wrong driving times or closed restaurants.
- We do not guarantee that a road is open, safe, legal or suitable for your vehicle, nor that a route is beautiful at the time given. Information on sun, glare and weather are forecasts.
- Traffic rules, road signs, instructions on site, road conditions and weather always take precedence. Before you drive, check closures, tolls, driving bans and whether the route is allowed for your vehicle (for example scooters on motorways, campers on mountain passes).
- Do not use the app while driving. Only stop where it is allowed and safe.
- You alone, as the driver, are responsible for the drive.
12. Warranty and liability
The statutory warranty rights apply, in particular under the Austrian Consumer Warranty Act (VGG). What is agreed is a service that delivers AI suggestions as described in sections 2 and 11, not checked routes or routes guaranteed to be passable.
We are liable without limitation for damage we cause intentionally or through gross negligence, for personal injury (injury to life, body or health) also in case of slight negligence, and under the Product Liability Act. We are not liable for slight negligence in case of other damage, as far as the law allows. The providers of third-party services (for example Google Maps, map and weather services) are responsible for their content and calculations.
13. Right of withdrawal
As a consumer you have a statutory right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG). This section explains what that means for Scenicway.
Withdrawal information
Right of withdrawal: you can withdraw from a contract with us within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract was concluded. To withdraw, you must inform us (Alen Kvakić, Mollardgasse 49-51, 1060 Wien, Austria, email [email protected]) of your decision by a clear statement, for example by email. You can use the model withdrawal form below, but you don't have to. To meet the deadline, it is enough to send your notice before the period ends.
Effects of withdrawal: if you withdraw, we refund all payments we received from you for this contract without undue delay and at the latest within 14 days from the day we receive your withdrawal. We use the same means of payment you used, unless we expressly agree otherwise. We charge you no fees for the refund. If you requested that a service (Roadtrip Pass or Pro) starts during the withdrawal period, you pay us a reasonable amount for the part we have already provided up to your withdrawal, in proportion to the total price.
What this means for each plan
- Route Pack (digital content): so that you can create routes right away, we ask you at purchase for your express consent that we start before the withdrawal period ends, and for your acknowledgement that you thereby lose your right of withdrawal. We confirm this to you by email. Your right of withdrawal ends as soon as you create the first route from the pack (§ 18 (1) no. 11 FAGG). As long as you have not created a route from the pack, you can withdraw within the 14 days and get the full price back.
- Roadtrip Pass and Pro (services): at your express request we start right away. You can still withdraw within 14 days. You then only pay for the days you had until the withdrawal: for the Pass 1/30 of the price per day started, for monthly Pro the daily share of the month, for yearly Pro 1/365 of the yearly price per day. We refund the rest. The right of withdrawal ends once the service has been fully provided (§ 18 (1) no. 1 FAGG). Because the Pass and a subscription period last longer than 14 days, this does not happen within the withdrawal period.
- The satisfaction rule (section 8) and your warranty rights apply regardless of withdrawal.
How you confirm this at checkout
Before paying you must actively tick these boxes. Without the ticks no purchase is possible.
- For all plans: "I accept the Terms and have read the Privacy policy."
- Route Pack: "I expressly agree that Scenicway starts right away, before the 14-day withdrawal period ends. I know that I lose my right of withdrawal as soon as I create the first route from the pack."
- Roadtrip Pass and Pro: "I expressly request that Scenicway starts right away, before the 14-day withdrawal period ends. I know that if I withdraw, I pay a share for the time already used, and that my right of withdrawal ends once the service has been fully provided."
Model withdrawal form
If you want to withdraw from the contract, you can fill in this form and send it to us, for example by email. You don't have to use it.

14. Privacy
How we handle your data is explained in the privacy policy.
15. Changes to these terms
For the Pack and the Pass, the terms that applied at purchase stay in force. If we want to change the terms or the price of a running Pro subscription, we email you at least 30 days in advance. The change only applies if you agree to it. If you don't agree, your subscription continues on the previous terms until the end of the period, and we may cancel it under section 7.
16. Law, jurisdiction, dispute resolution
- Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules. If you are a consumer, you keep the protection of the mandatory provisions of the law of the country where you have your habitual residence.
- For consumers, the statutory places of jurisdiction apply.
- We are not obliged and not willing to take part in proceedings before a consumer arbitration board. The former EU online dispute resolution platform was shut down on 20 July 2025.
17. Language and final provisions
These terms exist in German and English with the same content. If the versions differ, the German version applies, unless the English version is more favourable to you. If a provision is invalid, the others remain valid.
